ZAMAN Jewelry has spanned the ages and countries, the passion for jewelry has been transmitted from Lebanon to France. Each piece found at ZAMAN Jewelry, has a story as unique as its creation.

The general terms and conditions of sale presented herein define the conditions of sales and purchase under which ZAMAN Jewelry sells to its customers gold and silver Jewelry (hereafter the « Product(s) »)  through the website www.zamanjewelry.com (the « Site »).

This website is operated by ZAMAN Jewelry. Throughout the Site, the terms « we », « us » and « our » refer to ZAMAN Jewelry. ZAMAN offers this Site, including all information, tools and services available from this site to you, the customer, conditioned upon your acceptance of all terms, conditions, policies and notices stated here. By visiting our site and/ or purchasing something from us, the Customer engages in our « Service » and agrees to be bound by the following terms and conditions including those additional terms and conditions and policies referenced herein and/or available by hyperlink. These Terms & Conditions apply to all users of the site, including without limitation users who are browsers, vendors, customers, merchants, and/ or contributors of content. Please read these Terms & Conditions carefully before accessing or using our website. By accessing or using any part of the site, the Customer agrees to be bound by these Terms and Conditions of Sale. If the Customer do not agree to all the terms and conditions of this agreement, then the Customer may not access the website or use any services. If these Terms & Conditions of Sale are considered an offer, acceptance is expressly limited to these Terms & Conditions of Sale. Any new features or tools which are added to the current store shall also be subject to the Terms & Conditions of Sale. The Customer can review the most current version of the Terms & Conditions of Sale at any time on this page. We reserve the right to update, change or replace any part of these Terms & Conditions of Sale by posting updates and/or changes to our website. It is the Customer’s responsibility to check this page periodically for changes. Your continued use of or access to the website following the posting of any changes constitutes acceptance of those changes. Our store is hosted on Shopify Inc. They provide us with the online e-commerce platform that allows us to sell our product(s) and services to the Customer.

SECTION 1 - ONLINE STORE TERMS:

The Customer of the Site must be of legal age in his state or province of residence, or the Customer is the age of majority in his state or province of residence and the Customer has given ZAMAN Jewelry his consent to allow any of his minor dependents to use this site. The Customer may not use our product(s) for any illegal or unauthorized purpose nor may the Customer, in the use of the Service, violate any laws in his jurisdiction (including but not limited to copyright laws). The Customer must not transmit any worms or viruses or any code of a destructive nature. A breach or violation of any of the Terms & Conditions will result in an immediate termination of his Services.

SECTION 2 - GENERAL CONDITIONS:

ZAMAN Jewelry reserves the right to refuse service to anyone for any reason at any time. The Customer understands that his content (not including credit card information), may be transferred unencrypted and involve (a) transmissions over various networks; and (b) changes to conform and adapt to technical requirements of connecting networks or devices. Credit card information is always encrypted during transfer over networks. The Customer agrees not to reproduce, duplicate, copy, sell, resell or exploit any portion of the Service, use of the Service, or access to the Service or any contact on the website through which the service is provided, without express written permission by us. The headings used in this agreement are included for convenience only and will not limit or otherwise affect these Terms & Conditions.

SECTION 3 - ACCURACY, COMPLETENESS AND TIMELINESS OF INFORMATION:

ZAMAN Jewelry is not responsible if information made available on this site is not accurate, complete or current. The material on this site is provided for general information only and should not be relied upon or used as the sole basis for making decisions without consulting primary, more accurate, more complete or more timely sources of information. Any reliance on the material on this site is at your own risk. This site may contain certain historical information. Historical information, necessarily, is not current and is provided for your reference only. We reserve the right to modify the contents of this site at any time, but we have no obligation to update any information on our site. The Customer agrees that it is his responsibility to monitor changes to our site.

SECTION 4 - MODIFICATIONS TO THE SERVICE AND PRICES:

Prices for our Product(s) are subject to change without notice. ZAMAN Jewelry reserves the right at any time to modify or discontinue the Service (or any part or content thereof) without prior notice at any time. We shall not be liable to you or to any third-party for any modification, price change, suspension or discontinuance of the Service.

SECTION 5 - PRODUCT(S) OR SERVICES (IF APPLICABLE):

Certain product(s) or services may be available exclusively online through the website. These product(s) or services may have limited quantities and are subject to return or exchange only according to our Return Policy. We have made every effort to display as accurately as possible the colors and images of our product(s) that appear at the store. We cannot guarantee that your computer monitor's display of any color will be accurate. We reserve the right, but are not obligated, to limit the sales of our product(s) or Services to any person, geographic region or jurisdiction. We may exercise this right on a case-by-case basis. We reserve the right to limit the quantities of any product(s) or services that we offer. All descriptions of product(s) or product pricing are subject to change at any time without notice, at the sole discretion of us. We reserve the right to discontinue any product at any time. Any offer for any product or service made on this site is void where prohibited. We do not warrant that the quality of any product(s), services, information, or other material purchased or obtained by you will meet your expectations, or that any errors in the Service will be corrected.

SECTION 6 - ACCURACY OF BILLING AND ACCOUNT INFORMATION:

We reserve the right to refuse, cancel and terminate orders at any time for legitimate and/or legal reasons with our prior notice and at anytime.  We will also have the right to refuse any order place by the Customer with whom there is a dispute regarding a previous order, as well as any order not in conformity with these Terms and Conditions.

In such cases, we will inform the Customer by e-mail, with no obligation to provide justification.

We may, in our sole discretion, limit or cancel quantities purchased per person, per household or per order. These restrictions may include orders placed by or under the same customer account, the same credit card, and/or orders that use the same billing and/or shipping address. In the event that we make a change to or cancel an order, we may attempt to notify you by contacting the e-mail and/or billing address/phone number provided at the time the order was made. We reserve the right to limit or prohibit orders that, in our sole judgment, appear to be placed by dealers, resellers or distributors.

It is the Customer's responsibility to verify the accuracy of the information submitted on the Site. You agree to provide current, complete and accurate purchase and account information for all purchases made at our store. You agree to promptly update your account and other information, including your email address and credit card numbers and expiration dates, so that we can complete your transactions and contact you as needed. After your order validation, an acknowledgement of receipt will be sent to the Customer by e-mail summarizing your order (Product specification, price, payment methods). The validation of the Customer’s order will be considered as an unconditional acceptance of the hereinafter Terms and Condition of Sale.

SECTION 7 - PAYMENT:

The Website offers payment by Bank Card. When the order is finalized, ZAMAN Jewelry will confirm payment by sending the Customer a summary email.

The prices displayed on the Website can be expressed in EUR, GBP or USD according to your desire, excluding all taxes (French VAT and other taxes applicable on the day of the order). The costs of shipping, processing of the order and carriage are indicated before confirmation of the order. After confirmation of the order, if the prices are displayed in GBP or USD, the payment will be processed in EUR (euros) at the date of the purchase’s rate defined by the following application : AutoCurrency Switcher.

ZAMAN Jewelry may modify the prices of its product(s) at any time and without prior notification, particularly due to changes in the economic, legislative or fiscal framework. Product(s) are invoiced based on the rate in force when the Customer places the order.

Product(s) remain the full and complete property of the company ZAMAN Jewelry until the full price of each order has been paid to us.

In case of order’s cancellation, the Customer has 1 hour upon receipt of the summary email to use his right of cancellation. Within the next hour of the email’s receipt, the Customer must inform ZAMAN Jewelry of his decision via our page « Contact us » mentioning the order’s number.

For Lebanese Service, the Website offers a payment by Cash on Delivery, the payment will be processed in USD.

The validation of the Customer’s order will be considered as an unconditional acceptance of the hereinafter Terms and Condition of Sale.

SECTION 8 - DELIVERY OF THE PRODUCT(S):

The Product(s) are delivered to the shipping address specified on the order form. 

The Customer must pay the customs' duties and any other taxes due when product(s) are imported into the country where the delivery address is located. All formalities related to the delivery are also the entire responsibility of the Customer. The Customer is solely responsible for checking the import options for the Product(s) ordered with regard to the laws of the territory of the country of delivery.

The product(s) are delivered worldwide against signature. No delivery can be made to a hotel address or a post office box.

ZAMAN Jewelry undertakes to ship the order in the next twenty-four hours, on a working day, of your order confirmation. The working days are the following : Monday to Friday, except Lebanese public holidays. 

If a shipment could not be cleared or delivered for reasons that include, but are not limited to, any of the following : (i) the Customer’s address is incomplete, illegible, incorrect or cannot be located, (ii) the Customer’s place is closed, (iii) delivery is impossible of the unavailability or refusal of an appropriate person to accept delivery of sign for delivery of the shipment on the initial delivery attempt or reattempts, (iv) shipment is unable to clean customs. In such cases, but not limited to the above list, shipment will be returned to the Sender, ZAMAN Jewelry, and the Customer will be liable for any and all costs, charges and fees incurred in returning the shipment.

For Lebanese Service, the package is delivered by Gezairi Express. Only two consecutive delivery attempts will be made, a third attempt can be made at an additional charge for the Customer, otherwise package will be returned to us. The package will be handed to the Customer only after full payment of the Product(s).

SECTION 9 - RECEIPT OF THE PRODUCT(S):

Upon receipt of the Product(s), the Customer must immediately check, in the presence of the carrier, the condition of the packaging and the Product(s).

Upon receipt of the Product(s), if the packaging is damaged, torn or opened, the Customer must imperatively check the Product(s) it contains. If these product(s) have been damaged, the Customer must refuse the Package and specify the issue on the delivery note. This verification is considered to be performed as soon as the Customer, or the receiver of the Package, has signed the delivery note / slip. 

The client must then address to ZAMAN Jewelry via the Contact Info an email including the supporting documents showing the damaged within twenty-four hours following the reception of the Product(s).

SECTION 10 - CUSTOMER’S RIGHT OF WITHDRAWAL:

Th Customer has 14 days upon receipt of the Package to use his right of withdrawal. Before the expiration of this 14 days, the Customer must inform ZAMAN Jewelry of his decision via our page « Contact us » mentioning the order’s number.

The Customer must return the Product, at his own expense, to ZAMAN Jewelry at the address mentioned in our response email, at the latest within 14 days following the receipt of the Package.

The Customer has the possibility to choose the carrier of his choice. However, it is highly recommended to keep the proof of return, which requires that the Package is returned with tracking.

ZAMAN Jewelry will reimburse the Client not later than 14 days from the date of receipt of the Package by ZAMAN Jewelry. The refund will be made by bank transfer to the card used to pay the original invoice. It is not possible to replace or exchange retired Product(s). It will be necessary to place a new order online.

ZAMAN Jewelry is not responsible for returning duties and taxes. To receive a refund for your duties and taxes paid on a returned order, you will need to go through your local customs office as this fee is paid to the country of import.

! Be aware that each piece sent by ZAMAN Jewelry will be carefully analyzed before shipping. The return Product(s) must be in their original condition, not worn, damaged or used. ZAMAN Jewelry will not reimburse any Product(s) that are not in their original condition.

The responsibility of the Customer can be engaged in case of depreciation of the Product(s) resulting from manipulations other than those strictly necessary to establish the nature, characteristics, and proper functioning of the Product(s).

SECTION 11 - LEGAL WARRANTY:

ZAMAN Jewelry provides a warranty covering manufacturing defects of the jewelry as defined in the Articles L.217-4 and seq. of French Trade Code and Articles 1641 and seq. of the French Civil Code.  

The Customer must inform Zaman Jewelry and provide the supporting documents showing the assumed default via our page « Contact us » mentioning the order’s number. Our Customer Service will proceed to an expertise of the Product(s) upon receipt of supporting documents.

If the Product(s) is four to be defective, the Customer must return the Product to ZAMAN Jewelry at the address mentioned in our response email, at the latest within 14 days following our decision. ZAMAN Jewelry will reimburse the Client not later than 14 days from the date of receipt of the Package by ZAMAN Jewelry. The refund will be made by bank transfer to the card used to pay the original invoice.

This warranty does not apply in case of : (i) incorrect use and defects in use and/or (ii) damage due to a handling error, abusive or abnormal use, intentional or accidental physical modification, use for professional or commercial purposes and/or (iii) in the event of abnormal maintenance operations, in the event of a lack of maintenance and hygiene and/or (iv) in case of natural wear and tear and/or (v) interventions carried out on the jewelry by any person not authorized by the Customer Service as well as the deteriorations resulting from such an intervention.

SECTION 12 - OPTIONAL TOOLS:

ZAMAN Jewelry may provide you with access to third-party tools over which we neither monitor nor have any control nor input. You acknowledge and agree that we provide access to such tools” as is” and “as available” without any warranties, representations, or conditions of any kind and without any endorsement. We shall have no liability whatsoever arising from or relating to your use of optional third-party tools. Any use by you of optional tools offered through the site is entirely at your own risk and discretion and you should ensure that you are familiar with and approve of the terms on which tools are provided by the relevant third-party provider(s). We may also, in the future, offer new services and/or features through the website (including, the release of new tools and resources). Such new features and/or services shall also be subject to these Terms & Conditions of Sale.

SECTION 13 - THIRD-PARTY LINKS:

Certain content, product(s) and services available via our Service may include materials from third-parties. Third-party links on this site may direct you to third-party websites that are not affiliated with us. ZAMAN Jewelry is not responsible for examining or evaluating the content or accuracy and we do not warrant and will not have any liability or responsibility for any third-party materials or websites, or for any other materials, product(s), or services of third-parties. We are not liable for any harm or damages related to the purchase or use of goods, services, resources, content, or any other transactions made in connection with any third-party websites. Please review carefully the third-party's policies and practices and make sure you understand them before you engage in any transaction. Complaints, claims, concerns, or questions regarding third-party product(s) should be directed to the third-party.

SECTION 14 - USER COMMENTS, FEEDBACK AND OTHER SUBMISSIONS:

If, at our request, you send certain specific submissions (for example contest entries) or without a request from us you send creative ideas, suggestions, proposals, plans, or other materials, whether online, by email, by postal mail, or otherwise (collectively, 'comments'), you agree that we may, at any time, without restriction, edit, copy, publish, distribute, translate and otherwise use in any medium any comments that you forward to us. We are and shall be under no obligation (1) to maintain any comments in confidence; (2) to pay compensation for any comments; or (3) to respond to any comments. We reserve the right to correct any errors, inaccuracies or omissions, and to change or update information or cancel orders if any information in the Service or on any related website is inaccurate at any time without prior notice (including after you have submitted your order). We undertake no obligation to update, amend or clarify information in the Service or on any related website, including without limitation, pricing information, except as required by law. No specified update or refresh date applied in the Service or on any related website, should be taken to indicate that all information in the Service or on any related website has been modified or updated.

We do not warrant that the results that may be obtained from the use of the service will be accurate or reliable. You agree that from time to time we may remove the service for indefinite periods of time or cancel the service at any time, without notice to you. You expressly agree that your use of, or inability to use, the service is at your sole risk. SECTION 19 - COPYRIGHT AND INTELLECTUAL PROPERTY:

The Customer acknowledges that ZAMAN Jewelry Product(s) and any distinctive sign (image, photographs, packaging, name of Product(s), texts, illustrations, etc.) are the exclusive property of Zaman Jewelry and his company, with no time limit and worldwide.

The Customer agrees not to reproduce or use any of the Product(s) design, images, photographs, packaging, name of Product(s), texts, illustrations, trademarks, commercial name, technics used by ZAMAN Jewelry, as well as any action leading to the appropriation of these elements, whether or not they are protected by ZAMAN Jewelry through a trademark, design or copyright.

Therefore, any reproduction or use not authorized by ZAMAN Jewelry will be considered as a counterfeit liable to prosecution.

SECTION 20 - INDEMNIFICATION:

You agree to indemnify, defend and hold harmless ZAMAN Jewelry, subsidiaries, affiliates, partners, officers, directors, agents, contractors, licensors, service providers, subcontractors, suppliers, interns and employees, harmless from any claim or demand, including reasonable attorneys’ fees, made by any third-party due to or arising out of your breach of these Terms & Conditions of Sale or the documents they incorporate by reference, or your violation of any law or the rights of a third-party.

SECTION 21 - SEVERABILITY:

In the event that any provision of these Terms & Conditions is determined to be unlawful, void or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed to be severed from these Terms & Conditions, such determination shall not affect the validity and enforceability of any other remaining provisions.

SECTION 22 - TERMINATION:

The contract takes effect as soon as the order is completed and cannot not be unilaterally terminated by the Customer except in terms define in Section 10 « Customer’s right of withdrawal ». If in our sole judgment the Customer fail, or we suspect that you have failed, to comply with any term or provision of these Terms & Conditions of Sale, we also may terminate this agreement at any time without notice and you will remain liable for all amounts due up to and including the date of termination; and/or accordingly may deny you access to our Services.

SECTION 23 - ENTIRE AGREEMENT:

The failure of us to exercise or enforce any right or provision of these Terms & Conditions of Sale shall not constitute a waiver of such right or provision. These Terms & Conditions of Sale and any policies or operating rules posted by us on this site or in respect to The Service constitutes the entire agreement and understanding between the Customer and ZAMAN Jewelry and govern your use of the Service, superseding any prior or contemporaneous agreements, communications and proposals, whether oral or written, between you and us (including, but not limited to, any prior versions of the Terms & Conditions of Sale). Any ambiguities in the interpretation of these Terms & Conditions shall not be construed against the drafting party.

These Terms & Conditions of Sales and any separate agreements whereby we provide you Services shall be governed by the Lebanese Court in accordance with the laws of France.
